Terms of Use

These terms set out the agreement between you and us when you use DadWell. They cover your account, subscriptions, the community and what each of us can expect from the other. Please read them. If you do not agree with them, please do not use DadWell.

Our Privacy Policy (dadwell.app/privacy) and Cookie Policy (dadwell.app/cookies) explain how we handle your information. They are separate documents, but they apply alongside these terms.

1. About us

You can contact us at support@dadwell.app.

2. Who can use DadWell

To use DadWell you must:

  • be 18 or over;

  • live in the United Kingdom, which is currently the only country where DadWell is offered;

  • give us accurate information when you set up your account, and keep it up to date; and

  • use the account yourself. Accounts are for one person and cannot be shared or transferred.

3. What DadWell is, and what it is not

DadWell offers information, reflection tools and peer support for men whose partner is expecting a baby and for new dads. It includes weekly guides matched to your stage, a daily check-in, a library of articles and, for members on Plus, a private community of other dads with a similar due date.

DadWell is not a medical service and does not give medical, psychological or professional advice. Our guides are general information. They cannot take account of your circumstances or your partner’s, and they are no substitute for advice from your GP, midwife, health visitor or another qualified professional. If you are worried about your health or your partner’s or baby’s health, speak to a professional. DadWell is not an emergency or crisis service. If you or anyone else is in danger, call 999. For urgent medical help call NHS 111. Samaritans can be reached free, day or night, on 116 123.

Other members’ posts are their own views and experiences. They have not been checked by us and should not be relied on as advice.

4. Your account

You can create an account with an email address and password, or sign in with Google or Apple. Please keep your sign-in details private, and tell us straight away at support@dadwell.app if you think someone else has used your account. You are responsible for what happens on your account unless it was used without your permission and you were not at fault.

5. The free plan and Plus

DadWell has a free plan and a paid plan called Plus.

  • Free includes the daily check-in, the guides we mark as free, the pregnancy loss guide and our list of support services. Guides that are part of Plus show a short preview.

  • Plus adds every guide in the library, including all weekly guides and past weeks, and membership of the community for your due month.

We add, change and sometimes remove content and features to keep DadWell useful. If you have paid for Plus, we will not take away a main feature of Plus during a period you have already paid for, unless we have to for legal, safety or security reasons. If a change we make materially reduces what you are paying for, we will tell you, and you may cancel and ask the store for a refund in line with section 6.9.

6. Subscriptions

6.1 Plans and prices

  • Plus Monthly. Price: £7.99 a month. Free trial: 7 days. How it renews: Every month.

  • Plus Annual. Price: £49.99 a year. Free trial: 7 days. How it renews: Every year.

  • Founding 500. Price: £39.99 a year. Free trial: None. How it renews: Every year, at the Founding price, while it continues without a break.

Prices include VAT. The price you pay is the one shown by the App Store or Google Play when you confirm the purchase.

6.2 The Founding 500 plan

Founding 500 is available to the first 500 people who buy it. Your first year lasts 15 months: the 12 months you pay for, plus 3 months that we add to your membership. After that, it renews every 12 months at the Founding price for as long as the subscription continues without a break. If you cancel and later come back, the Founding price will no longer be available. If more than 500 people complete a purchase at almost the same moment, we will honour every purchase that completes. The Founding plan has no free trial.

6.3 Payment

Subscriptions are bought and paid for through the Apple App Store or Google Play, and the store’s own terms apply to the payment. We never see or store your card details. Your subscription is linked to the store account you bought it with.

6.4 Automatic renewal

Your subscription renews automatically at the end of each period, and the store charges you for the next period, unless you cancel at least 24 hours before the current period ends. The store may take the payment during the 24 hours before the period ends.

6.5 Free trials

The Monthly and Annual plans start with a 7-day free trial if you have not had one before. Unless you cancel at least 24 hours before the trial ends, your subscription will start and you will be charged the plan price. We will remind you before the trial ends. On some stores, cancelling during a free trial ends your access to Plus straight away.

6.6 How to cancel

  • iPhone: open the Settings app, tap your name, tap Subscriptions, then choose DadWell.

  • Android: open Google Play, tap your profile picture, tap Payments and subscriptions, then Subscriptions, then choose DadWell.

If you cancel, Plus stays active until the end of the period you have paid for, and then your account moves to the free plan. Deleting the app or deleting your DadWell account does not cancel a subscription. You need to cancel through the store.

6.7 Billing problems

If a renewal payment fails, the store may keep trying for a short grace period. We keep Plus active during that period. If the payment has still not gone through when it ends, your account moves to the free plan.

6.8 Price changes

We may change the price of a plan. If we do, we will tell you in advance, and the store will tell you too, asking for your agreement where its rules require it. A new price only applies from your next renewal after the notice period, and you can cancel before it takes effect. The Founding 500 price does not change while your Founding subscription continues without a break.

6.9 Your right to cancel and refunds

Under UK consumer law you may have the right to cancel a purchase within 14 days. When you start a subscription, you ask us to give you Plus straight away. If you then cancel within 14 days, you may receive a refund reduced to reflect the time you have already had access.

Because Apple and Google take the payment, refunds are made by them under their own policies:

If you have had a pregnancy loss and want to stop your subscription, please get in touch. We will help you cancel and support any refund request you make to the store.

Nothing in these terms affects your legal rights as a consumer.

6.10 Complimentary access

We sometimes give Plus to people free of charge, for example testers or partner organisations. If we do, we will tell the person how long it lasts. We may end complimentary access at the end of that period, or earlier if these terms are broken.

7. If something goes wrong

We will provide DadWell with reasonable care and skill. If Plus is not as described or does not work properly, tell us at support@dadwell.app. We will try to fix it. If we cannot fix it within a reasonable time, you may be entitled to a price reduction or a refund for the affected period, which the store will process. If digital content we supply damages your device or other digital content because we did not use reasonable care and skill, we will repair the damage or pay you compensation.

8. The community

8.1 Joining

The community is part of Plus, including the free trial. Members are grouped by the month their baby is due or was born. Before you post, you must accept our community guidelines. Community administrators appointed by us may take part in more than one group.

8.2 Posting anonymously

Anonymous posting is switched on by default. When you post anonymously, other members see a handle instead of your name. Our moderators can still see who wrote every post, so that they can deal with reports.

8.3 Community rules

The community works because people feel safe in it. The guidelines you accept when you join are: be kind; be honest; listen first and avoid unsolicited advice; keep what is shared inside the community; and report anything that feels wrong. In addition, you must not post anything that:

  • is illegal, or encourages or helps anyone to commit a crime;

  • threatens, harasses, bullies or intimidates anyone;

  • attacks people for their race, religion, sex, sexual orientation, gender identity, disability or any other protected characteristic;

  • sexualises children in any way, or is sexually explicit;

  • encourages or gives instructions for suicide, self-harm or eating disorders;

  • gives dangerous medical advice, or presents false health claims as fact;

  • shares another person’s private information, including details that could identify your partner, your baby or another member, without their permission;

  • pretends to be someone else, including a member of our team;

  • advertises, sells or promotes anything, or is spam; or

  • includes content you do not have the right to share.

8.4 Reporting

You can report any post or reply from the menu next to it. A member of our team reads every report. Nothing happens to a post automatically when it is reported. You can also report a concern by emailing support@dadwell.app.

8.5 What we may do

When content breaks these terms, or a member’s behaviour puts others at risk, we may take one or more of these steps, depending on how serious it is:

  • remove the post or reply;

  • ban the member from a community group for 7, 30 or 90 days, or permanently;

  • pause posting in a community group for a time;

  • suspend the account for 24 hours, 7 days, 30 days or until we lift it; or

  • close the account.

When we suspend an account, the app shows the reason and when the suspension ends. We remove illegal content as quickly as we can once we become aware of it, and we report it to the police or other authorities where the law requires it or where someone may be at risk.

8.6 Complaints and appeals

If your account is suspended, you can appeal from the suspension screen in the app, once every 24 hours. If you disagree with any other decision we have made about content or your account, if you think we have not dealt properly with a report, or if you want to complain about how we apply these rules, email support@dadwell.app with “Community complaint” in the subject line. A person will review your complaint. We aim to reply within 14 days and will tell you what we decided and why.

8.7 Your content

You keep ownership of everything you post. By posting, you give us permission to store it, show it to the members of the community group you posted in, and review it for moderation. This permission is non-exclusive and free of charge. It ends when you or we delete the content, except for copies we must keep for a limited time as described in our Privacy Policy. You are responsible for what you post.

9. Using DadWell properly

You must not:

  • copy, sell, or make DadWell’s guides or content available to others, other than by using the share button in the app;

  • try to get around Plus, the community rules or any limit we place on the service;

  • use automated tools to access DadWell or to collect content or information from it;

  • try to gain access to another person’s account or to our systems, or interfere with how DadWell works;

  • copy, change, decompile or reverse engineer the app, except where the law allows it; or

  • use DadWell for any business purpose.

10. Our content

DadWell’s guides, text, design and software belong to us or to the people who license them to us. We give you a personal, non-transferable licence to use the app on devices you own or control, for your own non-commercial use, in line with these terms and the store’s rules. You may share a guide with someone using the share button in the app.

11. Availability and updates

We work to keep DadWell available, but we cannot promise it will always be available or free from errors. We may need to pause it for maintenance, security or reasons outside our control. From time to time we release updates. Some may be needed to keep using DadWell, and some may need a more recent version of your phone’s operating system.

12. Ending this agreement

You can stop using DadWell and delete your account at any time from Settings. Remember to cancel any subscription with the store as well.

We may suspend or close your account if you seriously or repeatedly break these terms, if we have to by law, or if your use puts other people, DadWell or our systems at risk. Where it is reasonable, we will warn you first and give you a chance to put things right. If we close your account for reasons other than your breach of these terms while you have a paid subscription, you may ask the store for a refund of the unused part of your subscription, and we will support that request.

If we decide to stop providing DadWell altogether, we will give you at least 30 days’ notice and tell you how to get a copy of your information.

13. Our responsibility to you

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law does not allow us to limit or exclude. This includes your rights under the Consumer Rights Act 2015.

Subject to that, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that was not foreseeable. DadWell is for personal use, so we are not responsible for any loss of profit, business or business opportunity.

Because DadWell provides general information rather than advice, we are not responsible for decisions you make about your health or your family’s health based on our content or on posts by other members, where you have not sought professional advice.

Subject to the first paragraph of this section, our total liability to you in connection with DadWell is limited to the greater of £100 and the amount you paid for DadWell in the 12 months before the event that gave rise to the claim.

14. Other services

DadWell links to other organisations, such as charities and helplines, and some links open other apps like WhatsApp or Telegram. We are not responsible for their content or services.

15. Additional terms for iPhone users

If you downloaded DadWell from the Apple App Store, the following also applies:

  1. This agreement is between you and us, not Apple. We, not Apple, are solely responsible for DadWell and its content.

  2. Your licence to use DadWell is limited to using it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

  3. We are solely responsible for providing maintenance and support for DadWell. Apple has no obligation to do so.

  4. If DadWell fails to meet any warranty that applies to it, you may tell Apple, and Apple will refund the purchase price, if any, to you. To the fullest extent permitted by law, Apple has no other warranty obligation in relation to DadWell.

  5. We, not Apple, are responsible for dealing with any claim by you or anyone else relating to DadWell or your use of it. This includes product liability claims, claims that DadWell fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.

  6. If anyone claims that DadWell or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.

  7. You confirm that you are not located in a country that is subject to a UK or US government embargo or that has been designated as a terrorist-supporting country, and that you are not on any UK or US government list of prohibited or restricted parties.

  8. You must also comply with any third-party terms that apply when you use DadWell, such as your mobile network’s terms.

  9. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

  10. Our name, address and contact details are set out in section 1.

16. Changes to these terms

We may update these terms, for example to reflect changes to DadWell or to the law. If a change is significant, we will tell you in the app or by email at least 30 days before it takes effect, unless we need to make it sooner for legal or safety reasons. If you do not agree to the change, you can cancel your subscription and stop using DadWell before it takes effect.

17. General

  • Transfer. We may transfer our rights and obligations under these terms to another organisation. If we do, we will tell you, and your rights will not be reduced. You may not transfer yours.

  • Third parties. Apart from Apple as set out in section 15, nobody else has any right to enforce these terms.

  • Separate terms. If a court decides that part of these terms is unlawful, the rest continues to apply.

  • Delay. If we do not enforce our rights straight away, we can still enforce them later.

18. Law and courts

These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland, you can also bring proceedings in Scotland, and if you live in Northern Ireland, you can also bring proceedings in Northern Ireland. Nothing in this section removes any protection you have under the law of the part of the UK where you live.
